Haitian Diaspora: Faith in Action and Haitian Clergy File Amicus Brief

Faith in Action and 56 faith leaders with Haitian members filed an Amicus Brief in the Supreme Court in support of 352,959 Haitians at risk of losing their Temporary Protected Status (TPS).

The brief argues that DHS Secretary Kristi Noem violated the TPS statute by terminating protections for Haitian families. The law required Secretary Noem to review conditions in Haiti to determine whether they remained unsafe. Rather than do that, she simply declared that nothing prevented people from safely returning to Haiti.

The brief from faith leaders urges the Supreme Court “to recognize that by arbitrarily ignoring the deteriorating conditions in Haiti, Secretary Noem’s decision to remove TPS protection subverts both the plain language of the TPS statute and the moral imperative it codifies.”
